The U.S. International Trade Commission (USITC) today determined that the revocation of existing anti-dumping and countervailing duty orders on welded stainless steel pressure pipes imported from India could result in the continuation or recurrence of material damage within a reasonably foreseeable period.
Existing orders to import this product from India will remain in effect due to the affirmative decision of the committee.
Chair Jason E. Kearns, Vice Chair Randolph J. Stayin and Commissioners David S. Johanson, Rhonda K. Schmidtlein and Amy A. Karpel voted in favor.
Today’s action comes under the five-year (sunset) review process required by the Uruguay Round Agreement Act.For background information on these five-year (sunset) reviews, please see the attached page.

The Uruguay Round Agreements Act requires Commerce to rescind an anti-dumping or countervailing duty order, or terminate a stay agreement after five years, unless the Commerce Department and the U.S. International Trade Commission determine that revoking the order or terminating the stay agreement could result in dumping or subsidy ( business) and material damage (USITC) persists or recurs within a reasonably foreseeable time.
The Commission’s agency notification in the five-year review requires interested parties to submit responses to the Commission on the possible impact of the revocation of the order under review, as well as other information.Typically within 95 days of the establishment of the institution, the committee will determine whether the responses it receives reflect sufficient or insufficient interest in a comprehensive review.If the response to USITC’s agency notification is adequate, or if other circumstances warrant a full review, the committee will conduct a full review, which will include a public hearing and the issuance of a questionnaire.
The Commission does not normally hold a hearing or conduct further investigative activities in an expedited review.Commissioners’ injury determinations are based on an expedited review of existing facts, including the Commission’s prior injury and review decisions, responses received to their agency notifications, data collected by staff in connection with the review, and information provided by the Department of Commerce.The five-year (sunset) review on Welded Stainless Steel Pressure Pipes in India begins on 1 October 2021.
